Ninja Shark (Smart Hub Pty Ltd) reserves the right to cancel, at any time before delivery and for whatever reason, an Order that it has previously accepted. Ninja Shark (Smart Hub Pty Ltd) may do this for example, but without limitation, where:
(a) Ninja Shark (Smart Hub Pty Ltd)’s suppliers are unable to supply Goods that they have previously promised to supply;
(b) an event beyond Ninja Shark (Smart Hub Pty Ltd)’s control, such as storm, fire, flood, earthquake, terrorism, power failure, war, strike or failure of computer systems, means that Ninja Shark (Smart Hub Pty Ltd) is unable to supply the Goods within a reasonable time;

SECTION 20 – DISCOUNTS
Discounts, deals or gifts cards are available only for individual items or special created packages. Discounts do not apply to custom bundles - named family packages or family bundles. These custom bundles have already incorporated the discount as part of their builder, therefore any additional discount is not applicable. Should there be any error and an extra discount will be applied, we reserve the right to notify the customer to cover the difference in cost or cancel and fully refund the order.
Both our platform and also our policy does not allow to stack up multiple discounts.
SECTION 21 – GUARANTEED DELIVERY
The guarantee does not apply if we miss our promised delivery date because of an unforeseen circumstance outside of our control, such as a strike, natural disaster, severe winter storm, customs delays, or inaccurate delivery scans.
Attempted delivery on or before the guaranteed delivery date meets our delivery guarantee.
An offer by the carrier of a delivery appointment on or before the guaranteed delivery date meets our delivery guarantee.
If your item doesn't arrive by the guaranteed delivery date If the item you bought with Guaranteed Delivery doesn't arrive on time, we'll make it right.
To let us know, you can either:
- Receive a voucher that you can use on a future Ninja Shark purchase.
- Get a refund for the shipping cost (if you paid for shipping).
- Return the item for free and get a full refund if the listing offers returns.
- Let us know you didn't receive the items.
That's all you have to do! We'll process your request right away. Just make sure that you let us know within 30 days from the guaranteed delivery date.
Note: Vouchers will be available in checkout before you pay and they expire 30 days from the date they're issued.
SECTION 22 – PRODUCT WARRANTY
We are confident in the quality of our products and all items are covered by warranties. Below you'll find a list of all our warranty information.

Our warranties start on the day of purchase. When making a claim you will need the original receipt as proof of purchase.
Our goods come with guarantees that cannot be excluded under Australian consumer law. The contractual rights that you may be entitled to under the Ninja Shark Standard Warranty or Ninja Shark Lifetime Warranty are in addition to these statutory rights.
When you purchase Ninja Shark products, you will also receive coverage from the Ninja Shark Standard Warranty. You can also obtain additional benefits by purchasing the optional Ninja Shark Lifetime Warranty plan.
Should your product be defective, you can choose to make a claim under Australian consumer law, the Standard Warranty or the optional Lifetime Warranty (whichever is applicable).
The Standard Warranty lasts 12 months from the date of purchase and comes as part of each individual product.
The optional Lifetime Warranty covers the entire Lifetime of the product or 99 years from the data of purchase of the item.
Lifetime Warranty can be purchased as a separate add-on and needs to be added per purchase. All the items inside that specific order that contains the Lifetime Warranty add-on will be covered by this warranty.
You can't combine multiple orders and/or items from various orders with only 1 (one) Lifetime Warranty that has been added to a specific order.

The Ninja Shark Australia mobile message service (the "Service") is operated by Ninja Shark Australia (“Ninja Shark Australia”, “we”, or “us”). Your use of the Service constitutes your agreement to these terms and conditions (“Mobile Terms”). We may modify or cancel the Service or any of its features without notice. To the extent permitted by applicable law, we may also modify these Mobile Terms at any time and your continued use of the Service following the effective date of any such changes shall constitute your acceptance of such changes.
By consenting to Ninja Shark Australia’s SMS/text messaging service, you agree to receive recurring SMS/text messages from and on behalf of Ninja Shark Australia through your wireless provider to the mobile number you provided, even if your mobile number is registered on any state or federal Do Not Call list. Text messages may be sent using an automatic telephone dialing system or other technology. Service-related messages may include updates, alerts, and information (e.g., order updates, account alerts, etc.). Promotional messages may include promotions, specials, and other marketing offers (e.g., cart reminders).
You understand that you do not have to sign up for this program in order to make any purchases, and your consent is not a condition of any purchase with Ninja Shark Australia. Your participation in this program is completely voluntary.
We do not charge for the Service, but you are responsible for all charges and fees associated with text messaging imposed by your wireless provider. Message frequency varies. Message and data rates may apply. Check your mobile plan and contact your wireless provider for details. You are solely responsible for all charges related to SMS/text messages, including charges from your wireless provider.
You may opt-out of the Service at any time. Text the single keyword command STOP to +61483957434 or click the unsubscribe link (where available) in any text message to cancel. You'll receive a one-time opt-out confirmation text message. No further messages will be sent to your mobile device, unless initiated by you. If you have subscribed to other Ninja Shark Australia mobile message programs and wish to cancel, except where applicable law requires otherwise, you will need to opt out separately from those programs by following the instructions provided in their respective mobile terms.

If goods on the site are being sold by a third party, the listing will contain the Seller's details in addition to any terms of sale specific to the Sellers goods (such as delivery timetables).
25.2. By buying these goods, you are transacting directly with the Seller, and NinjaShark.com.au is not a party to the transaction. As a result, we do not control any aspects of the transaction, including the listing content and accuracy or the quality, shipping and delivery of the goods.
25.3. In addition to terms applicable to goods we sell, these terms also set out terms applicable to goods sold by third party Sellers.
25.4. You agree that as a platform for independent Sellers, we are not responsible for the transactions that occur between you and the Seller, nor are we responsible for the Seller's goods or services to the extent permitted by law, NinjaShark.com.au makes no warranty or representation regarding the standard of any goods or services to be supplied by the Seller.
